The reason for the same is that Bar Examinations in India have not been properly handled by Bar Council of India (<a href="http://www.barcouncilofindia.org/" target="_blank"><strong><em><span style="color: rgb(51, 51, 255);">BCI</span></em></strong></a>) and we did not find many reasons to keep the platform up to date in such a situation.<br /><br />From the very beginning there was a lack of foresight, planning, management and transparency in the whole exercise. Naturally, the All India Bar Examination (AIBE) failed to take off at the stipulated time on numerous occasions.<br /><br />Now it has been proposed by the BCI to conduct the AIBE in the month of March, 2011 somewhere around first week of March (6th March, 2011 as per media reports). However, the problem still remains the same. As on date, the BCI is still not prepared to handle the issues of AIBE in general and “Professional Legal Education” (PLE) in particular.<br /><br />By “Professional Legal Education”, we do not mean the graduation level Legal Education. We are waiting for a “Response” from BCI in this regard.<br /><br />As on the date of writing of this piece, the <a href="http://www.barcouncilofindia.org/" target="_blank"><strong><em><span style="color: rgb(51, 51, 255);">Website</span></em></strong></a> of BCI is down as the domain name of the same has not been renewed by BCI. The website may or may not come up again but if BCI decides to continue with its website, the same must be Rearranged, Reformulated and Properly Managed.<br /><br />The present website of BCI was “Overburdened” by information that was not relevant for the BCI. Further, it also put issues like “Lifelong Learning, Professional Trainings and Education, Lawyer’s Trainings, Legal Research and Innovation, etc in a “Casual Manner”.<br /><br />The BCI must start afresh in this regard with a “Clear and Effective Coordination” with the Law Ministry of India. On top of it are the fears and apprehensions of final year law graduates regarding the same. They have fears that their education at respective law school may not automatically empower them to clear the bar exams and they need some more time to exclusively prepare for the bar exam.<br /><br />Here starts the real problem. If the bar examination is a sub standard one and is mere formality, it would fail to bring required legal reforms in India. On the other hand, if the exam is a real and effective one, the students must hone up their existing legal knowledge and acumen as the pattern of their study and exams at law colleges/schools may be different from that of bar exams.<br /><br />I must confess that the burden is upon the BCI to tackle this arduous task effectively as well as graciously. On the one hand it has a greater responsibility towards the nation at large whereas on the other hand it must act as a guide and mentor for fresh law graduates. While the first task has been effectively taken up by the BCI the latter one, in my personal opinion, has been totally neglected by the BCI. Till now the BCI has not come up with a concrete plan regarding the bar exams. For instance, there is no information regarding the course contents, syllabus, dates of exam, authorities that would conduct the exams, suggested resources for preparation, institutions with whom it has tie ups, etc.<br /><br />While PTLB and Bar Examination Segment of Perry4Law have taken a small but significant step in this direction yet the initiative must come from BCI itself. We have started an “<a href="http://ptlbnews.noads.biz/moodle/"><strong><em><span style="COLOR: rgb(51,51,255)">Online Platform</span></em></strong></a>” where the registered students may have some guidance and insight regarding the course mentioned therein. This is a “Prototype” that may be adopted by BCI or the BCI may (if it thinks fit) rope us for their bar exams initiative.<br /><br />Whatever the choice the BCI exercises, it has to keep in mind at least two things. Firstly, it has to arrange all the matters pertaining to bar exams precisely and efficiently. Despite the lack of any indication from the Bar Council as to what form such exam would take and the likely timelines for its implementation, we already have <a href="http://barexaminationsindia.blogspot.com/2010/04/bar-examination-of-india-2010.html"><strong><em><span style="color:#3333ff;">websites</span></em></strong></a> that are beginning to offer coaching for potential bar aspirants!<br />With coaching centres mushrooming this early in the game, we can be sure that is the next big money spinner in the "legal" arena.<br /><div align="justify"><br />The advent of such coaching centres ought to alert us to the fact that a bar exam cannot be a proxy for effective regulation and accreditation of proper law schools/colleges. For students would simply focus on such bar training through centres, without bothering about the quality of legal education that they receive from the various law schools/colleges.Secondly, a bar exam simply tests one for his/her capability to practice the law (whether in a court room or in an advisory capacity). A good legal education on the other hand ought to do much more in terms of encouraging one to think critically, drive social change etc . Lastly, the pass or fail rates at the bar exam may not be much of an indication for how good the candidates' law school or college is. Only the successful candidates would be allowed to practice in Indian courts.<br /><br />To further this objective, the Directorate of Legal Education (DLE) set up by the BCI has initiated <a href="http://www.indiaedunews.net/Law/BCI_up_with_entry_level_exam_for_aspiring_lawyers_11452/"><strong><em><span style="color:#3333ff;">steps</span></em></strong></a> to conduct a qualifying bar examination in August-September 2010.
